The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedent.
Summary
Lav Kumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 46.060 litres of liquor from three motorcycles. The petitioner argued that he has a clean antecedent, was not arrested at the spot, and that the alleged link to the motorcycles is based solely on a disclosure by Murli Mishra without any documentary proof of ownership. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent by the trial court. If any antecedent is found, the bail would be cancelled; otherwise, it would be confirmed. The application for anticipatory bail was allowed.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Excise Act.
- Whether the petitioner’s clean antecedent and lack of arrest justify granting anticipatory bail.
- Whether a provisional anticipatory bail order subject to verification of antecedent is appropriate.
