Patna High Court

Madhav Yadav @ Madhu YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted subject to surrender within eight weeks, a bail bond of Rs 10,000 and two sureties, and compliance with Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Madhav Yadav, filed a bail petition fearing arrest in a case registered under several offences of the Bhartiya Nyaya Sanhita, 2023, later amended to include Section 109. The FIR alleges that, on the instigation of co‑accused Atma Yadav, the petitioner and nine others assaulted an informant and his brother with sticks, rods and bricks. The petitioner contended that the incident stemmed from a simple land dispute and that the assault allegation was vague and omnibus, essentially a case and counter‑case. The State opposed the bail, citing the seriousness of the charges. After considering the facts, the Court ordered that bail be granted provided the petitioner surrenders within eight weeks, furnishes a bail bond of Rs 10,000 with two sureties, and complies with the conditions of Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail can be granted in a case involving offences under Sections 126(2), 115(2), 118(1), 303(2), 351(2), 3(5), 308(4) and 109 of the Bhartiya Nyaya Sanhita, 2023
  • Whether the alleged assault arising from a land dispute justifies denial of bail
  • Whether the conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 are applicable
