Patna High Court

Saiyad AlamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner upon furnishing a bond of Rs 10,000 with two sureties.

Summary

The petitioner, a 20‑year‑old male, was arrested in connection with the alleged seizure of 84 litres of country‑made liquor from a motorcycle, charged under Section 317(5) of the Bharatiya Nyaya Sanhita and Sections 30(a) and 41(1) of the Bihar Prohibition & Excise Act. He contended that he was falsely implicated, had no possession of the liquor, was not the vehicle’s owner, and possessed a clean antecedent, having been in custody since 13 April 2026. The State opposed his bail application. After hearing both sides, the Court held that bail could be granted, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties of equal amount, subject to the satisfaction of the Exclusive Special Excise Court‑I, East Champaran. The order resulted in the petitioner’s release on bail.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under the Bharatiya Nyaya Sanhita and the Bihar Prohibition & Excise Act.
  • Whether the allegations of possession and ownership of the seized liquor establish a prima facie case justifying denial of bail.
