Patna High Court

Tinku ManjhiversusThe State of Bihar

Holding

The court granted provisional anticipatory bail to the petitioners, subject to bond, sureties, and verification of antecedents, with confirmation contingent on the absence of concealed prior cases.

Summary

Petitioners Tinku Manjhi and Raju Manjhi sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 31.5 litres of liquor from Dasai Manjhi's house. They contended they had no possession, the house did not belong to them, and they were implicated by a hostile chowkidar. The State opposed the bail. The High Court, after hearing counsel, granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties and subject to verification of their criminal antecedents under Section 482(2) of the BNSS. The order stipulated that if any petitioner concealed prior cases, the bail would not be confirmed for that individual; otherwise, the bail would be confirmed upon verification.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioners' alleged lack of possession and hostile implication justify bail.
  • Whether concealment of prior criminal antecedents affects the confirmation of anticipatory bail.

recovery is from a house which does not belong to the

petitioners and petitioners have no concern or relation with

Dasai Manjhi and they came to be implicated at the instance of

Chowkidar with whom they are on an inimical term. It is next

submitted that if Chowkidar was aware about the involvement

of the petitioners in the occurrence, then why he did not inform

the police prior to institution of the instant FIR, which casts an

                   6. Considering the submissions made by the learned
