The Court granted provisional anticipatory bail subject to bail bonds and verification of the petitioner’s antecedents.
Summary
The petitioner, Suraj Paswan, applied for anticipatory bail under Section 438 of the Cr.P.C. in a case registered under Section 30(a) of the Excise Act for alleged recovery of 16,800 litres of liquor from his joint family house. He argued that he was not arrested at the spot, the liquor was not in his conscious possession, and the concept of deemed possession had been abolished by the 2018 amendment to the Excise Act. The prosecution opposed the bail, contending the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish bail bonds of Rs.15,000 each and that the trial court verify his criminal antecedents. The order stipulated that if more than three prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted in a case under Section 30(a) of the Excise Act where the alleged liquor was recovered from a joint family house and the petitioner was not in conscious possession.
- Whether the abolition of the concept of deemed possession by the 2018 amendment to the Excise Act precludes the presumption of offender.
- Whether the petitioner’s antecedent of three prior cases affects the grant of anticipatory bail.
