The court allowed the anticipatory bail application, granting provisional bail subject to conditions under Section 438(2) Cr.P.C.

Summary

The petitioners, Ashish Kumar and Sahib Kumar, were implicated in a case under Section 317(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Excise Act for allegedly possessing 7.38 litres and 18.56 litres of liquor recovered from two motorcycles. They argued that they have no prior criminal record, were not arrested at the spot, are not owners of the motorcycles, and were implicated based on unnamed local information, which they claimed undermines the prosecution's case. The State opposed the anticipatory bail application. The High Court, applying Section 438(2) of the Criminal Procedure Code, directed that the petitioners be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 each with two sureties, subject to verification of their antecedent by the trial court. The order stipulated that if any criminal antecedent is discovered, the bail would be revoked; otherwise, the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 of the Cr.P.C.
  • Whether the petitioners have a clean criminal antecedent warranting bail.
  • Whether the allegations based on unnamed informant affect the merits of the bail application.
