Provisional anticipatory bail is granted to the petitioner subject to conditions and verification of his antecedent.

Summary

The petitioner, Ramesh Ray, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 30 litres of liquor from his residence, which is a joint family property. He argued he had no conscious possession of the liquor and possessed a clean antecedent. The State opposed his anticipatory bail. The Court noted that the 2018 amendment to the Excise Act removed the concept of deemed possession and that the allegation was based on secret information without proper investigation. Consequently, the Court granted provisional anticipatory bail, subject to a bail bond of Rs. 500 with two sureties and a six‑week surrender, and ordered verification of the petitioner’s antecedent before confirming the bail.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case under Section 30(a) of the Bihar Excise Act
  • Whether the alleged possession of liquor in a joint family house can be attributed to the petitioner
