Patna High Court

Amjad Khan @ Ajad KhanversusThe State of Bihar

Decided

DISPOSED

Holding

The court conditionally granted provisional anticipatory bail, subject to bond, sureties, and verification of the petitioner’s antecedent record.

Summary

The petitioner, Amjad Khan, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 76.92 litres of liquor from a location not belonging to him. He argued that the liquor was not in his conscious possession, the recovery site was public, and the complaint was filed by a hostile chowkidar, raising doubts about the prosecution's case. The State opposed the bail, noting the petitioner’s two prior NDPS cases, though one ended in acquittal. The High Court granted provisional anticipatory bail conditioned on a Rs.10,000 bond with two sureties and directed verification of the petitioner’s criminal antecedents. It further stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act where the accused claims lack of possession and hostile complaint.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
