Patna High Court

Ranjeet Kumar @ Ranjit RayversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Ranjeet Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 180 litres of liquor from an auto. He argued that he has a clean antecedent, was not caught in possession, is not the owner of the vehicle, and the case is based solely on a confessional statement made by Abhishek while in police custody, which he claimed lacks evidentiary value. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 500 with two sureties and that the trial court verify his criminal antecedent within six weeks. If any antecedent is discovered, the bail will not be confirmed; otherwise, the provisional order will be confirmed. The order is made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act where the accused was not found in possession of the liquor.
  • Whether a confessional statement made in police custody can form the basis for anticipatory bail denial.
