The court held that anticipatory bail may be granted conditionally under Section 438 CrPC when the petitioner has a clean antecedent and is not in actual possession of the contraband, subject to verification of her criminal record.
Summary
Dewanti Kumari applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, where 15 litres of liquor were recovered from a motorcycle she owned. She argued that she had a clean antecedent, was not in actual possession of the liquor, and that her husband had misused the vehicle without her knowledge. The State opposed the bail. The High Court, after considering the submissions, directed that she be released on provisional anticipatory bail upon furnishing bail bonds and two sureties, subject to verification of her antecedent. The court stipulated that if any criminal antecedent is discovered, the bail would be withdrawn; otherwise, it would be confirmed. The application was allowed with conditions under Section 438(2) CrPC.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC for an offence under Section 30(a) of the Excise Act.
- Whether ownership of the vehicle used in the alleged offence makes the owner liable for anticipatory bail denial.
- Whether the petitioner’s clean antecedent and lack of actual possession justify granting anticipatory bail.
