The Court allowed the anticipatory bail application, granting provisional bail subject to conditions and verification of antecedents.
Summary
The petitioners, three members of the Manjhi family, applied for anticipatory bail under Section 438 of the Cr.P.C. in connection with a case (PS‑395/2025) alleging offences under Sections 30(a) and 30(d) of the Excise Act for the alleged recovery of 8.5 litres of liquor from their joint family house. They argued that the liquor was not in their conscious possession, the house is a joint family property and the amendment to the Excise Act in 2018 had done away with the concept of deemed possession, making the charge based on secret information. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to the petitioners furnishing bail bonds of Rs 5,000 each with two sureties, complying with Section 438(2) Cr.P.C., and further conditions including verification of their criminal antecedents and a deposit of Rs 2,500 with the Lawyers’ Association. The order stipulated that if the antecedent verification revealed more than the disclosed cases, the bail would not be confirmed. The application was allowed.
Issues considered
- Whether anticipatory bail can be granted under Section 438 Cr.P.C. to persons accused of offences under Sections 30(a) and 30(d) of the Excise Act where the alleged liquor was recovered from a joint family house.
- Whether the alleged recovery of liquor constitutes possession sufficient to deny anticipatory bail, considering the amendment removing deemed possession.

recovered from their conscious possession and even the house in
question is a joint family property and thus, it cannot be alleged
with certainty that it were the petitioners, who had kept the liquor
in the house or the liquor kept in the house was within their
knowledge and after Amendment in the Excise Act, 2018, the
concept of deemed possession and presumed offender has been
done away with and they came to be implicated based on secret

without holding a proper investigation, more so when person is
already implicated in a case relating to excise from before.

8. It is made clear that the learned trial Court after
accepting the provisional bail bonds of the petitioners shall verify
the criminal antecedent of the petitioners and in the event, if it is
found that petitioner nos.1 and 2 have antecedent of more than one

would be presumed that petitioners for the purposes of obtaining
anticipatory bail had concealed their antecedent before this Court,
in that event, the present provisional anticipatory bail order shall
not be confirmed, but if on verification, it is found that petitioner
nos.1 and 2 have antecedent of one case only and petitioner no.3
has antecedent of even one case, in that event, the provisional
anticipatory bail order shall be confirmed forthwith.
