The Court allowed the anticipatory bail application conditionally, subject to verification of the petitioner’s antecedent and compliance with Section 438(2) CrPC.

Summary

Anil Kumar Yadav applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 221.625 litres of liquor. The petitioner argued that he was not arrested at the spot, no liquor was found in his possession, and the alleged recovery occurred at a public place based on secret information. The State opposed the bail, citing the petitioner’s antecedent of five prior Excise cases. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.25,000 with two sureties and that the trial court verify his criminal antecedent. The order stipulated that if more than five prior cases are found, the bail would be cancelled; otherwise, it would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC for an offence under Section 30(a) of the Excise Act given the petitioner’s prior criminal antecedent and lack of possession of the alleged contraband.
