Provisional anticipatory bail is granted subject to verification of the petitioner’s antecedents and compliance with bail conditions.

Summary

The petitioner, Sanjay Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Section 109(1) of the B.N.S.S. 2023, alleging recovery of 991.5 litres of liquor from vehicles he owned. He argued he had a clean antecedent, was not in possession of the liquor, and was unaware that his vehicle would be misused. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.500 with two sureties and directing the trial court to verify his criminal antecedents. If any antecedent is found, the bail may be revoked; otherwise, it will be confirmed. The order is subject to the conditions of Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances.
  • Whether ownership of the vehicle used in the alleged offence makes the petitioner liable.
  • Whether the petitioner’s clean antecedent warrants grant of bail.
