Patna High Court

Pratima SinhaversusThe State of Bihar

Decided

DISPOSED

Holding

The Court held that the petitioner may be released on provisional anticipatory bail subject to conditions and verification of her antecedent.

Summary

Petitioner Pratima Sinha, owner of a vehicle, feared arrest in a case under Sections 30(a) and 41(1) of the Bihar Excise Act relating to the seizure of 1987.2 litres of liquor and Rs. 4,700 from an oil tanker and three vehicles. She argued that she was not present at the spot, had no conscious possession of the liquor, and was unaware that a co‑accused would misuse her vehicle. The State opposed her prayer for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and conditioned on verification of her criminal antecedent within six weeks, after which the order may be confirmed or set aside.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the inherent powers of the High Court in a case under the Bihar Excise Act.
  • Whether ownership of a vehicle used in the alleged offence makes the petitioner liable for anticipatory bail.
  • Whether the petitioner’s criminal antecedent must be verified before confirming anticipatory bail.
