Dipak Kumar @ Deepak Kumar PaswanversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Dipak Kumar Paswan, sought anticipatory bail in a case under Section 30(a) of the Bihar Excise Act alleging recovery of liquor from two motorcycles he owned. He argued that he was not in possession of the liquor, was unaware of his brother's alleged misuse of the vehicles, and that ownership alone should not implicate him. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail conditioned on a Rs.10,000 bond with two sureties and directed verification of the petitioner’s criminal antecedents. It further stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Criminal Procedure Code in a case under the Bihar Excise Act.
  • Whether mere ownership of a vehicle used in the alleged offence justifies arrest and denial of bail.
  • How the petitioner’s criminal antecedent affects the grant and confirmation of anticipatory bail.
