BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Munna Yadav was arrested in connection with a case of looting a motorcycle and assaulting the informant, alleged under Section 309(4) of the B.N.S., 2023. The prosecution alleged that nine miscreants, including the petitioner, stole cash, cards and a mobile phone and assaulted the victim. The petitioner contended that he was not named in the FIR, no incriminating material was found on him, and he was falsely implicated without any investigation such as a T.I.P. He also highlighted that he had been in judicial custody since 5 July 2025 despite having four prior criminal antecedents. The State opposed bail, but the court, considering the lack of direct evidence and the period of custody, decided to grant bail. The bail was conditioned on a bond of Rs. 15,000 with two sureties, one of whom must be a close family member, and the petitioner’s attendance at all trial dates.
