Holding
The Court conditionally granted provisional anticipatory bail to the petitioner, subject to bail bonds, sureties and verification of his criminal antecedent.
Summary
The petitioner, Md Naushad, sought anticipatory bail fearing arrest in a case registered under Sections 318(4), 112(2), 61(1) of the Bihar Narcotic Substances Act, Section 11 of the Gambling Act and Section 30(a) of the Bihar Excise Act, alleging recovery of 1.8 litres of liquor, 21 motorcycles, a scooty and a bicycle. He contended that he was not present at the spot of seizure, none of the contraband was in his conscious possession, and the vehicles were seized from a location not belonging to him; his only connection was ownership of one motorcycle allegedly used by a friend. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and conditions under Section 482(2) of the Criminal Procedure Code. The order further directed the trial court to verify the petitioner’s criminal antecedent and to confirm the bail only if he has at most one prior case, otherwise the bail would not be confirmed.
Issues considered
- Whether the petitioner is entitled to anticipatory bail despite the serious nature of the offences alleged under the Bihar Narcotic Substances Act, Gambling Act and Bihar Excise Act.
- Whether the petitioner’s alleged ownership of a seized vehicle and alleged lack of possession of contraband justify granting anticipatory bail.
