Holding
The Court granted provisional anticipatory bail to the petitioner subject to specified conditions.
Summary
The petitioner, Subhash Kumar, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 46 litres of liquor were recovered from a bush adjacent to his field, with no possession or arrest at the spot. He argued that the police mechanically implicated him based on a watchman's report without proper investigation. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.5,000 bail bond with two sureties, verification of his criminal antecedent, and a deposit of Rs.2,500 with the High Court Legal Services Committee. The order stipulated that if more than one antecedent case is found, the bail would not be confirmed, whereas confirmation would follow if only one antecedent is verified.
