The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent.
Summary
The petitioner, Lalbabu Ram, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 5.8 litres of liquor recovered from his house, which he claims is joint family property and that he had no conscious possession. He argued that the 2018 amendment to the Excise Act abolished the concepts of deemed possession and presumed offender, and that the complaint was motivated by an inimical chaukidar. The State opposed the bail. The High Court, considering the clean antecedent claim and the factual disputes, granted provisional anticipatory bail subject to a Rs.500 bond, two sureties, and a condition that the trial court verify his antecedent; if any prior case is found, the bail would be revoked. The petitioner also undertook to deposit Rs.2,500 with the High Court Legal Services Committee. The order is provisional, pending verification.
Issues considered
- Whether anticipatory bail can be granted under Section 438 Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the concept of deemed possession applies post‑2018 amendment to the Excise Act.
- Whether the petitioner’s claim of joint family ownership negates alleged possession.

was within his knowledge and after amendment in the Excise
