Holding

The Court granted provisional anticipatory bail to the petitioner subject to specified conditions and verification of antecedents.

Summary

The petitioner, Govind Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 5 litres of liquor from his motorcycle. He argued that the liquor was not found in his possession, that he was unaware his friend misused the vehicle, and that ownership of the vehicle should not implicate him. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and a condition that the petitioner deposit Rs.5,000 with the Advocates’ Association. The order also stipulated verification of the petitioner’s criminal antecedents, with confirmation of bail contingent on finding no more than two prior cases.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the circumstances alleged
  • Whether ownership of the vehicle used in the alleged offence makes the owner liable under Section 30(a) of the Bihar Excise Act
  • Whether the petitioner’s criminal antecedents affect the grant of anticipatory bail
