Patna High Court

Naina Chaudhary @ Naina RaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs 10,000 bond with two sureties.

Summary

The petitioner, Naina Chaudhary, sought bail in a case alleging trafficking of minor girls and related offences under multiple statutes. The prosecution alleged that she, along with co‑accused, was involved in bringing minors from other states for exploitation by an orchestra company. The petitioner contended she is a woman falsely implicated, with no specific allegation of sexual assault, no involvement in exploitation, and a clean antecedent, having been in custody since 4 December 2025. The State opposed bail, asserting her participation in the alleged trafficking. Considering the non‑specific nature of the allegations, the petitioner’s gender, clean record, and length of custody, the court ordered her release on bail upon furnishing a bond of Rs 10,000 with two sureties. The bail order was directed to be complied with by the Additional District and Sessions Judge‑Special Judge, POCSO Act, Nalanda.

Issues considered

  • Whether bail should be granted to the petitioner despite allegations of trafficking and exploitation of minor girls under multiple statutes
  • Whether the non‑specific nature of allegations and the petitioner’s clean antecedent justify bail
