The court held that anticipatory bail is to be granted subject to conditions and verification of the petitioner’s antecedent record.
Summary
The petitioner, Trivuwan Chaudhary, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 10 litres of liquor from a scooty registered in his wife's name. The petitioner argued that he was not arrested at the spot, no liquor was found in his conscious possession, and he was implicated solely because of his prior excise cases and the vehicle registration. The State opposed the bail, citing the seriousness of the offence and the petitioner’s antecedent record. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000, two sureties, verification of the petitioner’s criminal antecedents, and a deposit of Rs.5,000 with the Advocates’ Association. The order stipulated that if more than three prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted under Section 438(2) CrPC for an offence under Section 30(a) of the Excise Act.
- Whether the petitioner’s prior excise cases affect the grant of anticipatory bail.
- Whether the absence of seizure from the petitioner’s conscious possession justifies anticipatory bail.
