CHINTA DEVIversusThe State of Bihar

Holding

The Court held that anticipatory bail is to be granted provisionally, subject to verification of the petitioner’s antecedent, under Section 438(2) of the CrPC.

Summary

The petitioner, Chinta Devi, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 12.5 litres of liquor. She argued that she has a clean antecedent, is a woman, and that the liquor was recovered from a location not belonging to her, implicating her through a false complaint by a watchman hostile to her husband. The State opposed the bail. The Court, considering these submissions, directed that she be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of her criminal antecedent. If any antecedent is found, the bail would be cancelled; otherwise, it would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC to the petitioner accused under Section 30(a) of the Excise Act.
  • Whether the petitioner’s clean antecedent and lack of possession of the alleged liquor justify granting bail.
  • What conditions should be imposed on the provisional anticipatory bail.

whom her husband is on an inimical term. It is also submitted

that in order to coerce her husband into submission the
