The Court held that provisional anticipatory bail should be granted subject to the conditions specified under Section 438(2) of the CrPC.

Summary

The petitioner, Lav Kush, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 82 litres of liquor and seizure of a motorcycle. The petitioner argued that he was not in possession of the seized items, had no ownership of the premises, and was implicated based on secret information without proper investigation. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000 with two sureties, subject to verification of his criminal antecedents. The order also required the petitioner to deposit Rs.2,500 with the Advocates’ Association, Patna High Court. The application was allowed, with the proviso that if more than two prior cases are found, the bail may be withdrawn.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC in the present circumstances
  • Whether the petitioner’s alleged lack of possession and ownership justifies bail
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail
  • Whether the conditions imposed under Section 438(2) are satisfied
