Holding

The Court granted provisional anticipatory bail to the petitioner subject to specified conditions and verification of his antecedent.

Summary

Saheb Kumar was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly recovering 105 litres of liquor from bags kept in front of a temple. He argued that he was not arrested at the spot, that the liquor was not in his conscious possession, and that the location was public, contending that the investigation was mechanically driven without proper inquiry. The State opposed his application for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.10,000 with two sureties and a condition that the petitioner deposit Rs.5,000 with the Patna High Court Lawyers’ Association. The order also stipulated that the trial court verify the petitioner’s criminal antecedent; if more than two prior cases are found, the bail would not be confirmed, otherwise it would be confirmed. The decision was based on the provisions of Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in the present excise case
  • Whether the alleged facts constitute sufficient ground to deny anticipatory bail
