Holding

The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent, under Section 438(2) of the Criminal Procedure Code.

Summary

Manoj Kumar Data, the owner of a licensed liquor shop in Dhanbad, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for the alleged recovery of 1,400 litres of liquor from a "magic vehicle." The petitioner argued that he had no arrest, no possession of the liquor, and a clean antecedent, contending that mere purchase of liquor from his shop should not implicate him without proper investigation. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds and sureties, subject to verification of his criminal antecedent. The order stipulated that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted in the absence of arrest and possession for an offence under Section 30(a) of the Excise Act.
  • Whether ownership of a licensed liquor shop suffices to implicate the petitioner without further investigation.
  • What conditions must be imposed under Section 438(2) of the Cr.P.C. for provisional anticipatory bail.

                   learned APP for the State.

                                2. The petitioner seeks bail in anticipation of his

arrest in a case registered for the offences punishable under

Section 30(a) of the Excise Act.

                                3. The learned counsel for the petitioner submits that

the petitioner is a person with clean antecedent and allegation is

                                4. The learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the liquor shop

at Dhanbad from where the liquor was purchased. It is

of Jharkhand. It is further submitted that merely because the

liquor was purchased from his shop that in itself is not a ground

for implicating the petitioner in the case without holding a

          proper investigation.

                       5. Learned A.P.P. opposes the anticipatory bail

counsel for the petitioner, the petitioner, above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

sum of Rs.500/- (Rupees Five Hundred) with two sureties of the

                       7. The application stands allowed.

                       8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

the criminal antecedent of the petitioner and in the event, if it is
