The court granted provisional anticipatory bail subject to conditions under Section 438(2) of the CrPC.
Summary
The petitioner, Amar Chaudhari, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for allegedly recovering 50 litres of liquor from a motorcycle. He argued that he was not arrested at the spot, had no conscious possession of the seized liquor, and was implicated by a watchman without proper investigation. The State opposed the bail, citing the petitioner’s antecedent of six prior cases, five of which were under the Excise Act. The Court, after considering the submissions, directed the petitioner to be released on provisional anticipatory bail upon furnishing bail bonds of Rs.30,000 with two sureties, and imposed conditions including verification of his criminal antecedent. The order also required the petitioner to deposit Rs.10,000 with the Advocates’ Association, and stipulated that if more than six antecedent cases are found, the bail would not be confirmed.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Excise Act.
- Whether the petitioner’s criminal antecedent of six cases affects the grant of anticipatory bail.
