The Court allowed the anticipatory bail application, subject to bond, sureties and verification of antecedents.

Summary

Munna Kumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with offences under Sections 30(a) and 41 of the Excise Act, alleging that the liquor seized from a scooty belonged to a friend and that he was not in possession at the time of the alleged offence. The petitioner disclosed two prior criminal cases, one also under the Excise Act, and argued that ownership of the vehicle should not automatically implicate him. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and a verification of the petitioner’s criminal antecedents. The order further stipulated that if more than two prior cases are found, the bail would not be confirmed, and the petitioner must deposit Rs.2,500 with the Advocates’ Association.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for offences punishable under Sections 30(a) and 41 of the Excise Act.
  • Whether mere ownership of the vehicle used in the alleged offence is sufficient to deny anticipatory bail.
  • How the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
