Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s criminal antecedents.

Summary

Ramashankar Ray was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly possessing 26.5 litres of liquor in a hardware shop that is part of a joint family business. The petitioner argued that he was not arrested on the spot, no liquor was found in his conscious possession, and it could not be proved that he had knowledge of the liquor in the shop. The State opposed his request for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.5,000 with two sureties and that the trial court verify his criminal antecedents. The order further stipulated that if the petitioner is found to have more than one prior case, the bail would not be confirmed; otherwise, it would be confirmed immediately.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act

use his own premises for committing an occurrence and thus
