Dilip PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

The petitioner, Dilip Paswan, applied for bail in a criminal case registered under Sections 274 and 275 of the Indian Penal Code and Section 30(a) of the Excise Act, alleging recovery of 130 litres of liquor and 3000 litres of semi‑manufactured jawa‑mahua solution from a joint family house. He contended that he has a clean antecedent, was not arrested at the spot, and that the liquor was not in his conscious possession, as the property is jointly owned. The State opposed the bail. The Court considered the lack of direct possession, the petitioner’s clean record, and the nature of the property, and ordered his release on regular bail upon furnishing a bond of Rs.5,000 with two sureties of the same amount. The bail application was allowed.

Issues considered

  • Whether bail should be granted to the petitioner charged under IPC Sections 274, 275 and Excise Act Section 30(a).
  • Whether the petitioner’s lack of conscious possession and the joint family ownership of the property negate the charge.
  • Whether the petitioner’s clean antecedent warrants bail despite the seriousness of the offences.
