Provisional anticipatory bail is granted subject to bail bonds, sureties and verification of the petitioner’s antecedents, with confirmation contingent on the finding of no more than two prior cases.

Summary

Shravan Paswan sought anticipatory bail fearing arrest under Section 30(a) of the Bihar Excise Act for allegedly recovering 8.5 litres of liquor. He argued that the alleged liquor was seized from a location not belonging to him and that the case was based solely on a confessional statement of another accused, with no material recovered from his possession. The petitioner also disclosed two prior cases under the Excise Act. The State opposed the bail. The Court granted provisional anticipatory bail conditioned on a Rs.10,000 bail bond with two sureties and directed verification of the petitioner’s criminal antecedents; if more than two prior cases are found, the bail would not be confirmed, otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s prior two cases under the Excise Act affect the grant of anticipatory bail.
  • Whether the reliance on a confessional statement of another accused suffices for arrest.
