Anticipatory bail was denied because the nature and gravity of the offences and the specific allegations against the petitioners did not justify such relief.
Summary
The petitioners sought anticipatory bail in a case (Shahpur Patory PS Case No. 46 of 2025) where they were alleged to have assaulted an informant’s husband and Vashisht Singh, leading to the husband’s death. The FIR named eight accused, including the petitioners, and invoked several sections of the Bharatiya Nyaya Sanhita, 2023. The petitioners argued they were falsely implicated due to a land dispute and had no criminal record, citing that a co‑accused had already been granted regular bail. The State opposed the relief, emphasizing specific allegations of assault against the petitioners. Considering the seriousness of the offences and the specific accusations, the Court declined to grant anticipatory bail, directing the petitioners to surrender and apply for regular bail before the trial court.
Issues considered
- Whether anticipatory bail can be granted to the petitioners under the Bharatiya Nyaya Sanhita, 2023 in view of the alleged offences.
- Whether the nature and gravity of the offences and specific allegations against the petitioners preclude anticipatory bail.
- Whether the petitioners’ claim of false implication and lack of criminal antecedent merit the grant of anticipatory bail.
