The court granted provisional anticipatory bail to the petitioner, subject to bail bonds and verification of his antecedent.
Summary
The petitioner, Arun Kumar Yadav, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in a case registered under Section 30(a) of the Excise Act for alleged recovery of three litres of liquor from his motorcycle. He argued that he has a clean antecedent, was not arrested at the spot, and had no conscious possession of the liquor, asserting that ownership of the vehicle does not imply participation in the offence. The State opposed the bail. The court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his antecedent by the trial court. The order stipulated that if any prior case is found, the bail would be cancelled; otherwise, it would be confirmed. The application for anticipatory bail was allowed.
Issues considered
- Whether anticipatory bail should be granted under Section 438 CrPC to a person alleged to be involved in an offence under Section 30(a) of the Excise Act.
- Whether the petitioner’s lack of conscious possession and clean antecedent justify the grant of anticipatory bail.
- What conditions should be imposed on the provisional anticipatory bail.
