Ajay Thathera @ Ajay KumarversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Summary

The petitioner, Ajay Thathera, was implicated in a theft case involving three aluminum coils allegedly stolen from S.J.V.N. Power Plant, with the prosecution alleging he purchased one of the coils. The petitioner contended he has no business in coil trade, no criminal record, and no incriminating material was found on him, asserting false implication. The State opposed bail, emphasizing the seriousness of the offences under Sections 303(2), 317(2) and 3(5) of the Bhartiya Nyaya Sanhita. The court examined the merits and, considering the lack of direct evidence against the petitioner, granted anticipatory bail subject to a bond of Rs.15,000 and two sureties, with conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023. The order directs the petitioner to surrender within six weeks if arrested.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023 despite the seriousness of the alleged offences.
  • Whether the prosecution has established a prima facie case sufficient to deny anticipatory bail.
