Provisional anticipatory bail may be granted if the petitioner is not in possession of the contraband and pending verification of his antecedents, subject to conditions under Section 482(2) of the BNSS.

Summary

The petitioner, D.R. Kumar, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging the seizure of 2,289 litres of liquor from a mini‑truck, a car and a motorcycle linked to his poultry farm. He contended that he was not arrested on the spot, that none of the liquor was found in his conscious possession, and that he was unaware of any misuse of his vehicles by a friend. The State opposed his application for anticipatory bail. The Court examined these submissions and noted the lack of direct possession and the petitioner’s claim of innocence, while also considering his prior criminal antecedent of two cases. It granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditioned the order on verification of his antecedents. The order further stipulated that if more than two prior cases are discovered, the bail would not be confirmed, but if only two are found, the provisional bail would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in a case under Section 30(a) of the Bihar Excise Act where he claims no possession of the contraband
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail

would use his own vehicle for committing an occurrence and

in the event if it is found that petitioner has antecedent of more

than two cases then it would be presumed that petitioner, for the
