Holding

The court allowed the anticipatory bail, granting provisional bail subject to conditions and verification of antecedents.

Summary

Petitioner Prabhawati Kunwar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, alleging that liquor was recovered from a public pond near her house and not from her possession. She has five prior cases under the Excise Act and argued that the police had implicated her without proper investigation. The State opposed the bail. The High Court, after considering the submissions, directed that she be released on provisional anticipatory bail upon furnishing a bail bond of Rs.25,000 with two sureties, and subject to verification of her criminal antecedents. The court stipulated that if more than five prior cases are found, the bail would not be confirmed; otherwise it would be confirmed. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC to a person accused of offences under Section 30(a) of the Excise Act.
  • Whether the absence of possession of the seized liquor and the public nature of the location affect the grant of bail.
  • Whether the petitioner’s prior five cases under the Excise Act preclude the grant of anticipatory bail.
