The Court allowed the anticipatory bail application, subject to conditions, under Section 438 CrPC.

Summary

The petitioner, Sonu Kumar, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 175 litres of liquor from a public place. He argued that he was not in possession of the liquor, that the recovery was based on secret information, and that he has only two prior cases, one of which is also under the Excise Act. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties, verification of his criminal antecedents, and a condition to deposit Rs.2,500 with the Advocates’ Association. The order also stipulated that if more than two prior cases are found, the bail would not be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Excise Act.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
