Holding

The court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Basant Yadav, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for allegedly recovering 116.935 litres of liquor from a motorcycle. The petitioner argued that he was not in possession of the seized vehicle, was not the owner, and was implicated only due to the testimony of a watchman, questioning why the watchman did not inform police earlier. The State opposed the anticipatory bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.15,000 with two sureties, subject to verification of his criminal antecedents. The court clarified that if the petitioner is found to have more than three prior cases, the provisional bail would not be confirmed; if he has exactly three, the bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in a case under Section 30(a) of the Excise Act
  • Whether the petitioner’s alleged lack of ownership and possession of the seized vehicle affects the grant of bail
  • Whether the petitioner’s criminal antecedent (three prior cases) warrants denial of anticipatory bail
