Anticipatory bail was granted conditionally, subject to verification of the petitioner’s antecedent and compliance with Section 482(2) of the BNSS.

Summary

The petitioner, Ramakant Paswan, applied for anticipatory bail in a case registered under Section 30(a) of the Excise Act for alleged possession of 15 litres of liquor. The petitioner argued he had a clean antecedent and that the alleged recovery was made from persons apprehended by police, not from his conscious possession, relying solely on a confessional statement of the apprehended accused, which he claimed lacks evidentiary value. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent and compliance with Section 482(2) of the BNSS. The court clarified that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Excise Act where the allegation is based solely on a confessional statement of another accused.
  • Whether the petitioner’s clean antecedent is a condition for confirming the provisional anticipatory bail.
