Patna High Court

Abhishek KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Abhishek Kumar, was arrested on 20 November 2025 after 50 litres of liquor were recovered from a plastic sac in a public place, and was charged under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for bail, contending that he had no possession of the liquor, no involvement in its sale, a clean criminal record, and that no incriminating material was found on him. The State opposed the bail, arguing the seriousness of the offence. The court examined the facts, noting the petitioner’s clean antecedent, the lack of material evidence, and the non‑compliance of Section 103 of the B.N.S.S., 2023, and decided to grant bail. Accordingly, the petitioner was released on bail upon furnishing a bond of Rs.15,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the accused in an offence under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of arrest and evidence.
  • Whether the non‑compliance of Section 103 of the B.N.S.S., 2023, affects the grant of bail.
