Mamta DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioners have a prima facie case for pre‑arrest bail and directed their release on bail.

Summary

Mamta Devi and Vimla Devi, mother and grandmother of the accused Basist Kumar, applied for pre‑arrest bail in a kidnapping case involving a minor girl under Sections 96 and 3(5) of the BNS and Sections 8 and 12 of the POCSO Act. The FIR alleged that Basist Kumar kidnapped the girl, but the victim’s statement recorded under Section 183 BNSS indicated that the father had lodged a false case. The petitioners argued that no specific allegation was made against them, they have clean antecedents, and the main accused had already been released on bail. The State opposed the bail. The Court, after considering the submissions, held that the petitioners had made out a prima facie case for bail and ordered their release on pre‑arrest bail subject to conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioners can be granted pre‑arrest bail under Section 482(2) of the BNSS in a case registered under Sections 96, 3(5) of the BNS and Sections 8, 12 of the POCSO Act.
  • Whether the allegations in the FIR against the co‑accused Basist Kumar extend to the petitioners.
