BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the stipulated conditions.

Summary

Shankar Mandal and his wife Anita Devi applied for anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 109, 118(1), 351, 352 and 3(5) of the B.N.S., 2023. The dispute arose from a land disagreement between the petitioners and the informant, who are brothers, leading to an altercation on 24.03.2025 where the petitioners allegedly attacked the informant and his son with an axe, causing injuries, while the petitioner also sustained a head fracture. The petitioners argued they have clean antecedents and that the allegations are not specific. The State opposed the anticipatory bail. The Court, considering the mutual injuries, the petitioner's medical condition, and the lack of prior criminal record, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S.S. in view of the alleged offences and the facts of the case
