The Court held that anticipatory bail could not be granted to the petitioner.
Summary
The petitioner, Brajesh Kumar, sought anticipatory bail fearing arrest in a case (P.S. No.138/2025) involving multiple offences under the B.N.S., 2023, arising from a dispute over road construction on land claimed to be privately owned by the informant. He argued that the road was part of a government scheme and that he was falsely implicated, also highlighting his prior criminal history and the fact that a similar bail application by a co‑accused had been rejected. The State, represented by the public prosecutor and the informant’s counsel, contended that the road was indeed on private land, that the petitioner had a history of cases, and that no scheme document was produced to justify the construction. The Court examined the allegations, the petitioner’s antecedents, and the precedent of the earlier bail denial, and concluded that the seriousness of the charges and the lack of justification warranted denial of bail. Consequently, the anticipatory bail application was rejected.
Issues considered
- Whether the petitioner is entitled to anticipatory bail in view of the alleged offences and his prior criminal antecedents
- Whether the road construction was on private land, thereby justifying the charges of forcible trespass and related offences
- Whether the precedent of a similar bail denial for a co‑accused influences the present application
