Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to bond and surety conditions.

Summary

Anuj Kumar was implicated in a case registered under Sections 103 and 3(5) of the Bharatiya Nyaya Sanhita for the alleged killing of an informant's son. The petitioner contended that the accusation was based solely on suspicion, with no eyewitness testimony and that the deceased had died by suicide, as indicated by the post‑mortem report. He also highlighted his clean antecedent and the absence of any material evidence linking him to the crime. The State opposed the bail application, arguing the seriousness of the charge. The Court, after considering the lack of evidentiary support and the petitioner's clean record, granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order directed that if arrested within eight weeks, the petitioner be released on bail upon compliance with the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted in a case where the accusation is based on suspicion and lacks eyewitness evidence
  • Whether the petitioner's clean antecedent and the circumstances of the deceased's death justify bail
