Holding

Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Deepak Mahto, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act involving alleged recovery of 250 litres of liquor from two motorcycles. He argued that he was not in possession of the liquor, did not own the vehicles, and was implicated solely on the testimony of a chowkidar, questioning the adequacy of police investigation. The State opposed the bail, noting the petitioner’s criminal antecedent of nine prior cases. The Court granted provisional anticipatory bail conditioned on a bail bond of Rs.45,000 with two sureties and directed verification of the petitioner’s criminal record. It further held that if the verification reveals more than nine prior cases, the bail would be revoked; otherwise, the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s criminal antecedent of nine cases affects the grant of anticipatory bail.
