Patna High Court

Arvind Sao @ Arvind Saw @ Arvindra SawversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to monetary and surety conditions and mandatory appearance requirements.

Summary

Arvind Sao was arrested after 75 litres of liquor were recovered from an e‑rickshaw and was charged under Sections 30(a), 41 and 56(b) of the Bihar Prohibition and Excise Act. The petitioner contended that he was falsely implicated, that no incriminating material was found in his conscious possession, and that he had no prior criminal record. The State opposed the bail application. The Court considered the lack of material evidence, the petitioner’s clean record and the fact that Section 103 of the B.N.S.S., 2023 had not been complied with, and decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s appearance at every trial date. Failure to appear on two consecutive dates would permit cancellation of the bail.
