BAIL GRANTED

Holding

The High Court granted bail to the petitioner subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

Arvind Kumar Sah was arrested in a case registered under Sections 108, 3(5) and 120(B) of the Bhartiya Nyaya Sanhita, 2023, based on allegations by an informant that he and co‑accused had tortured the informant's husband, forced the closure of his C.S.P. centre and that the husband subsequently committed suicide. The petitioner, a primary school teacher, contended that he had no involvement and that the accusations were motivated by business rivalry with another C.S.P. operator. The State opposed his bail, arguing the seriousness of the offences. The High Court, after considering the lack of material linking the petitioner to the alleged acts and his clean antecedents, ordered that bail be granted if he surrenders within eight weeks, upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount, subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. The order was pronounced by Justice Prabhat Kumar Singh.
