Holding

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedents.

Summary

The petitioner, Tuntun Choudhary, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Sections 30(a), 34 and 36 of the Excise Act for allegedly recovering 520 litres of spirit from a public road. The petitioner argued that he was not arrested at the spot, that the alleged contraband was not in his possession, and that the case was based on secret information and a mechanical confessional statement. The State opposed the bail, contending the seriousness of the offences. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000 with two sureties, subject to verification of his criminal antecedents. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 CrPC for offences under the Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
  • Whether the absence of recovery of the alleged spirit from the petitioner’s possession justifies bail.
