Gore Lal Singh @ Gore Lal SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to anticipatory bail subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

Gore Lal Singh (also known as Gore Lal Sharma) applied for anticipatory bail fearing arrest in a case registered under multiple sections of the Bharatiya Nyaya Sanhita. He argued that the FIR specifically implicates another accused, Umesh Singh, and that no direct allegation of assault is made against him. The petitioner highlighted his daughter's upcoming marriage and noted that Umesh Singh had already been granted anticipatory bail. The State opposed the bail, contending the seriousness of the offences. The Court, after considering the submissions, granted anticipatory bail to the petitioner, subject to a bail bond of Rs.25,000 with two sureties and conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bharatiya Nyaya Sanhita despite the pending FIR.
  • Whether the allegations in the FIR specifically implicate the petitioner, justifying denial of anticipatory bail.
