Disposal
BAIL REJECTED

Holding

The Court denied bail to the petitioner.

Summary

The petitioner, Jhunnu Kumar Singh, was charged under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act for allegedly assaulting the son of an informant. He has been in custody since 23‑12‑2024 and previously applied for regular bail (Cr. Misc No. 35637 of 2025), which was rejected. The informant’s counsel stated that the trial is underway and seven of ten prosecution witnesses have already been examined, indicating substantial evidence against the petitioner. The petitioner’s counsel could not rebut these submissions. Considering the seriousness of the offences, the stage of the trial, and the evidence presented, the Court declined to grant bail. Consequently, the petition for bail was rejected.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences and the stage of trial
  • Whether the evidence presented by the prosecution justifies denial of bail

is the second attempt of the petitioner to seek regular bail. It is

next submitted that petitioner had earlier moved before this
